SMS Text Messaging Program Terms and Conditions

By providing your mobile phone number to International Cruise Food & Hotel Suppliers, Inc. (“ICFH”) and opting in to receive SMS text messages, you agree to receive text messages from ICFH at the mobile phone number you provided, and you accept and agree to these SMS Terms of Service and our Privacy Policy.

1. Program Description

ICFH’s SMS program allows customers and business partners to receive important text message communications, including:

  • Order confirmations and status updates
  • Delivery schedules and notifications
  • Product availability alerts
  • Appointment reminders
  • Customer service messages
  • Account notifications
  • Promotional offers and product updates (with separate opt-in)

2. Consent Not Required for Purchase

Your consent to receive text messages is not a condition of purchasing any goods or services from ICFH. You may continue to place orders and conduct business with ICFH regardless of whether you opt in to SMS communications.

3. Message Frequency

Message frequency varies based on your order activity and preferences:

  • Transactional messages: You may receive up to 10 messages per month related to orders, deliveries, and account activity.
  • Marketing messages: If you opt in to promotional communications, you may receive up to 4 marketing messages per month.

4. How to Opt In

You can opt in to receive SMS messages from ICFH by:

  • Checking the SMS consent box on our website contact form
  • Texting a keyword (if provided) to our short code or phone number
  • Providing your mobile number and verbal consent to our customer service team
  • Checking the SMS option when placing an order

5. How to Opt Out

After you opt out, you will receive one final confirmation message acknowledging your request. You will no longer receive promotional or non-essential messages from ICFH. However, you may continue to receive critical transactional messages related to pending orders until those transactions are completed.

7. Message and Data Rates

ICFH is not responsible for any charges incurred from your mobile carrier. Please contact your mobile carrier for information about your specific messaging and data plan rates.

  • Verizon Wireless
  • Sprint
  • Boost Mobile
  • Cricket
  • MetroPCS
  • U.S. Cellular
  • Virgin Mobile
  • And other major carriers

Carrier coverage and message delivery are not guaranteed. ICFH is not responsible for delayed or undelivered messages.

9. Privacy and Data Use

ICFH respects your privacy and will handle your mobile phone number and related information in accordance with our Privacy Policy.

We will NOT share, sell, rent, or disclose your mobile phone number or SMS opt-in information with third parties for their marketing purposes.

Your mobile phone number will only be used by ICFH to send you the types of messages described in these terms.

10. Accuracy of Information

You are responsible for providing accurate and current mobile phone number information. If you change your mobile phone number, please update your contact information with ICFH by calling (305) 653-2042 or contacting us through our website.

11. Age Requirement

You must be 18 years of age or older to opt in to ICFH’s SMS program. By opting in, you confirm that you are at least 18 years old and are the account holder or have the account holder’s permission to opt in to receive text messages at the mobile number you provided.

12. Service Availability

ICFH’s SMS service is provided on an “as is” and “as available” basis. We do not guarantee that the service will be uninterrupted, timely, secure, or error-free. ICFH reserves the right to modify, suspend, or discontinue the SMS service at any time without prior notice.

13. Limitation of Liability

ICFH, its service providers, and mobile carriers are not liable for:

  • Delayed or undelivered messages
  • Any charges from your mobile carrier
  • Issues related to your mobile device or carrier service
  • Any damages or losses resulting from your participation in the SMS program

14. Indemnification

You agree to indemnify, defend, and hold harmless ICFH, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the SMS service or violation of these terms.

15. Changes to Terms

ICFH reserves the right to modify these SMS Terms of Service at any time. We will notify you of material changes by posting the updated terms on our website or by sending you a text message. Your continued participation in the SMS program after changes are made constitutes your acceptance of the revised terms.

16. Governing Law

These SMS Terms of Service are governed by the laws of the State of Florida and the United States, without regard to conflict of law principles. Any disputes arising from these terms will be resolved in the state or federal courts located in Miami-Dade County, Florida.

17. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These SMS Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and ICFH regarding the SMS program and supersede all prior or contemporaneous communications.
